Title: Am I Out Of Line? Opinions Please

On the 13th of December, I placed an order with a vendor who shall remain nameless at this time.  On the vendor's page, it says to wait 14 days maximum for the package to arrive, and if it does not, to place a dispute.

I waited 14 days.  I placed the item into dispute, and commented on the dispute that the item had not been received.  2 days later, I sent a personal message to the vendor, letting them know the item was in dispute, and kindly asking for a DCN.  I did not get a reply to this message until today -- it's been several days.  5 days went by after the dispute was filed, and the vendor had not replied either to the dispute nor my message, so the SR admin granted me a 100% refund.

Today, I get a reply from the vendor, DCN included, and he basically said I walked away with his money and did not follow his terms of service.  Indeed the terms of service were followed by me.  I am not happy with being called a scammer -- I've been on SR for 9 months and this was my first (hopefully last) dispute.  All the above said, I finally offered to remit a partial payment to him.  Is this wrong?  Should I be sending him the entire value, nothing at all, or is partial the right thing to do at this point??

IMO send him nothing. Vender should of checked messages more often.

not your fault.

im a vendor, so i know how it is. its too bad for him but he needs to check on SR more often if hes gonna sell stuff on here.

The vendor had 5 days to get their shit together. If they needed more than 5 days, all they had to do was clicky on a link and ask for another few days.

If they had produced a proper DCN during resolution, and followed the very fucking simple rules for resolution and asking for additional time, I doubt very much you would have received a 100% refund.

But they didn't do any of those things.

And you got 100% back.

I dunno, I see the system working exactly as it should here.

Well, yes, and no.
If you are saying the vendor was slow so you pulled a faster one on him.
You got the goods, and the money?
Fuck him, right?
Holidays, Vacation, mail overload, screw him!

Well, I guess it depends on if you ended up getting the product or not... and what the DCN said happend:  missent?  Insufficent address?  Returned to Sender?  Delivered?  Delivered to wrong town/zip code?   humm..   I guess to know whats right you really need to provide more information... that being said, the vendor should have provided the DCN during the resolution process, not afterwards.

Heres what it really comes down to: did you get it finally?  if so then you should pay up.  if not then based on the DCN's report you should decided what to do.  Realistically you dont have to do anything cause you followed the resolution process correctly and the vendor did not provide a response or DCN during the allotted and agreed upon time frame so tuff luck for the vendor.  Ethically, if you got it later cause it was "missent" by usps and subsequently delayed then you owe the vendor for the goods.  If it was "insufficient address" or "returned to sender" then the ball is up in the air... but like i said the time to discuss these two possibilities has actually passed... you be the judge now.

i agree with paper and everyone else who's saying to do the right thing.

ok, it got a bit messed up, communication was bad, etc.  you have it in your hands now though.  you should pay for AT LEAST some of it.

this is a community.  not being honest and ethical about things like this undermines the community.

  It all depends on whether you finally received the product. If you never received, it's unfortunate, but that's how I understand the system to work. I myself believe in a 50-50 split with no re-sends, unless it was an address mistake, and then the maker of the mistake pays.
  If you did receive, then in my opinion you should pay the full amount and ding the seller 2 points on the feedback, with a note that resolution was outside the resolution period.
  Most important thing there is that you stayed in escrow, which even gave you the options. I support that decision.

Two seperate times with two seperate vendors I've cancelled orders that sat at processing for too long (I believe it was 5-6 days before I decided to just get my BTC back), and ended up getting shipped the product.

One vendor noticed, one vendor didn't. I paid both, because it's the right thing to do.

So, I would take the same approach on this...you did everything by the book. Keep the 100% refund unless the product shows up, in which case you should pay him the cost in current bitcoin value. Nothing to feel bad about, that's the right way to go about it. Assure the vendor that you'll pay up if the product arrives.

Even though he fucked up, if you received the package pay him....Just don't do anymore business with his slow unprofessional ass....

I tend to agree with paying the vendor if you got your product but definitely leave the appropriate feedback. If you didn't get the product than keep the money and call it a day.
